Writ against reinstate of article 96 of Constitution

DHAKA: A writ petition was filed with the High Court seeking its directives to halt a government initiative to bring back article 96 of 1972 constitution word by word by amending the constitution.

Supreme Court lawyer Dr Yunus Ali Akand filed the writ with related department of the High Court on Sunday.

Allude to on Thursday, parliamentary standing committee chairman of law ministry Suranjit Sen Gupta said government will bring back article 96 of 1972 constitution to uphold country’s sovereignty.

Following his statement, Yunsu Akand filed the writ as if the amendment have passed justices will have to face grilling to parliament.

Article 96 of the 1972 constitution authorised the legislature, with a two-third majority, to impeach apex court judges for misconducts and violating constitution.

Earlier, the provision was dropped from the country’s charter through military orders and instituted a new mechanism – the Supreme Judicial Commission, headed by the chief justice and two other senior judges.

Installation of the new mechanism curtailed the legislature’s authority to make the judiciary accountable to the people’s representatives.
