Review plea against 16th amendment verdict in 28 days: AG

DHAKA: Attorney General Mahbubey Alam said the government has 27 days left to file the review plea against the Supreme Court verdict that scrapped the 16th amendment to the constitution.

He made the comment to reporters in his own office on Tuesday (Nov 28).

Attorney General said, “I told that we will file the review plea against the verdict within November but it seems not possible. However, we have received the certified copy of the verdict yesterday and that gives us 27 more days to file the review with the Supreme Court.”

“We have already assembled the arguments (grounds) based on which the review plea will be filed. Now refining and polishing work is going on.”

Earlier on Aug 1, the full verdict was released. A team led by the attorney general has been scrutinizing the 799-page long verdict since then and preparing for the review petition.

On July 3, a seven-member bench of the Appellate Division, headed by Chief Justice SK Sinha, delivered the verdict, upholding the HC’s decision that declared the 16th amendment to the Constitution illegal.

The Supreme Court also dismissed an appeal filed by the state side against the HC verdict.

The HC in its verdict on May 5 in 2016 scrapped the 16th constitutional amendment that restored the Parliament's authority to dismiss the SC judges on grounds of incapacity or misconduct.
