HC dismisses writ on CJ appointing

DHAKA: The High Court on Sunday (January 28) dismissed a writ petition seeking directives for appointing new Chief Justice, saying it wasn’t moved at the court.

The HC bench of Justice Jinat Ara and Justice Kazi Md Ijarul Haque Akanda passed the order.  

Deputy Attorney General Ishrat Jahan said that the court dismissed the writ claiming it wasn’t moved at the court. Petitioner of the writ, lawyer Yunus Ali said that he wasn’t present at the court Sunday.
 
Earlier, the HC adjourned the motion hearing on the writ for a week on January 21, responding an appeal from the state seeking time.

The court earlier fixed January 21 for conducting the motion hearing on the writ.

However, keeping the post of the CJ vacant and not appointing a new one why won’t be declared unconstitutional, asked the writ.

Moreover, the writ petition sought a rule to be issued on why necessary instruction won’t be given asking to appoint a CJ and other justices from the lawyers as per the Article (95) of the constitution.
