Legal notice served to pay compensation to child Jihad's family

DHAKA: A lawyer has sent a legal notice to the authorities concerned, asking them to pay Tk. 20 lakh to family of the four-year-old Jihad for his tragic death.

Barrister Md Abdul Halim of Children Charity Bangladesh Foundation sent the legal notice on behalf Jihad’s family. The lawyer confirmed the matter to the Banglanews on Tuesday (January 23).

He said that they asked the authorities concerned to pay the compensation money within two weeks as they did not accomplish the High Court order in this regard.

The notice was served to Director General of Bangladesh Railway and Director General of Fire Service and Civil Defence.

It was said in the notice that a case over contempt of court will be filed with the High Court if the compensation money will not be paid within the timeframe.

The ill-fated child Jihad died after falling into a deep pipe of an abandoned railway pump at Shahjahanpur Railway Colony in the city on December 26 in 2014.

Twenty-three hours into his fall, the body was recovered by a volunteer group using indigenous tool on December 27 despite the Fire Service and Civil Defence authorities repeated claim during rescue operation that there was no one inside trapped.

On December 28, the Children’s Charity Bangladesh Foundation filed a writ petition with the High Court, seeking its directives to give Tk. 30 lakh to Jihad’s family as compensation.

On February 18 in 2016, the HC bench of Justice Farah Mahbub and Justice Kazi Md Ejarul Haque Akondo delivered the verdict. In the verdict, the court had said that the government would have to compensate the family of Jihad.

On October 09 in 2016, the higher court released the full text of verdict asking the authorities concerned to pay Tk. 20 lakh as compensation to the family.  

According to the HC verdict, the Railway authorities have to pay Tk. 10 lakh, while the Civil Defense authorities will pay the rest Tk. 10 lakh to the family.

The court ordered them to hand over the amount to the father and mother of child within 90 days.
