HC orders to dispose 139 prisoners’ cases by Aug 31

DHAKA: The High court on Monday (Feb 19) asked the trial courts concerned to dispose cases filed against 139 accused, who are in prison for seven years due to delay in trial proceedings, within August 31.

An HC bench of Justice M Enayetur Rahman and Shahidul Karim passed the order on a suo moto (voluntary) move after Supreme Court Legal Aid Committee panel lawyer Kumar Debul Dey brought the matter to court’s attention. 

On Nov 19 last year, Supreme Court Legal Aid committee sent to letters to Inspector General of Prison seeking the list of prisoners who are detained in 68 jails of the country for more than seven years due to slow progress in trial proceedings.

In response, Jail authority sent a list of 256 prisoners on December 31. After scrutinizing the list, cases of 139 accused were brought to court’s attention. 

After the HC order, lawyer Debul Dey told Banglanews, “The court ordered respective trial courts to end the trial proceedings of 139 inmates within August 31. The trial court judges concerned were also asked to submit reports on the trial progress to the committee.”  

Moreover, the respective probe officers of the cases were directed to produce witnesses before court for hearing. The HC also asked authorities concerned to take divisional action against the probe officer who will defy that order.

Of the 139 inmates who are in jail for over seven years, 44 are in jail in Dhaka division, 43 in Chittagong Division, 16 in Rajshahi Division, 12 in Sylhet Division, one in Barisal Division, 5 in Khulna division and 10 in Rangpur Division and 8 in Mymensingh division.
