SC upholds Darul Ihsan varsity closure order

DHAKA: The Appellate Division of the Supreme Court (SC) on Wednesday (February 8) upheld the High Court order to shut the activities of Darul Ihsan University (DIU).

A four-member appellate division bench, led by Chief Justice Surendra Kumar Sinha, handed down the verdict canceling the appeal plea filed by the authorities of the private varsity against the HC order.

Attorney General Mahbubey Alam moved as the prosecutor while M Amir-Ul Islam, Barrister Rokon Uddin Mahmud, and Zahirul Huq moved in favor of the plea. Lawyer ABM Bayezid moved for UGC.

The AG said the order should be a warning for all the private universities operating in the country. “No one will be allowed to use education as a product.”

On April 13 in 2016, HC pronounced the verdict after hearing 12 writ petitions filed by a group of people and students claiming ownership of DIU at different times.

The HC order said that before the law this is not a university. “It has to be demolished.”

The court also fined the trustees Tk 10-lakh each.

Authorities of DIU and other private universities filed a Leave to Appeal plea against the HC order.

Later on July 26 of that year, education ministry shut the activities of 135 campuses of DIU.

Education Minister Nurul Islam Nahid, on the next day, said the students of DIU can claim Tk 5-lakh from the authorities for continuing education.

The government will help students in this regard, he added.
