DHAKA: Lawyers of former Jamaat Ameer Ghulam Azam Tuesday pleaded to the International Crime Tribunal (ICT) for transferring case against Ghulam Azam to Tribunal-2 from Tribunal-1.
The lawyers submitted an application under International Crime Law 11(KA) to ICT register office around 1:00pm.
According to the plea, “Justice Nizamul Hoque has violated the code of conduct 1, 2, 6 (KA), (Gha) and 4 of section 96 (4-KA) by participating in the trial of war criminal Ghulam Azam.”
The lawyers said, “Mass Court formed Ekatturer Ghatak Dalal Nirmul Committee on March 26, 1992 for the trial of Ghulam Azam, which gave him capital punishment.”
Justice Nizamul Hoque appealed to the government on April 10, 1992 to implement the punishment order.
Nizamul Hoque cannot take part in the trial as he was secretariat member of the Ekatturer Ghatak Dalal Nirmul Committee, they claimed.
The lawyers added, as there is another ICT, so we are applying to transfer it there.
On May 13, the International Crime tribunal-1 on Sunday framed charges against former Jamaat Ameer Prof Ghulam Azam, detained for trial on charges of wartime crimes against humanity during liberation war in 1971.
Earlier on December 26 last, International Crimes Tribunal (ICT) returned the war crimes charges brought against former Jamaat chief Ghulam Azam, terming those ‘scattered and irrelevant’.
The tribunal also directed the chief prosecutor to resubmit the formal charges against Ghulam Azam properly by the time (January 5) through its registrar office.
On December 12 last, formal charges of ‘crime against humanity’ were submitted against Ghulam Azam for his role during the Liberation War and appealed for issuing arrest warrant against him.
A total of 52 allegations were complied in the charge book against Azam, who was Ameer of the erstwhile East Pakistan chapter of the Islamic party that sided with the Pakistan government during the liberation war.
As per the allegations, the prosecutor petitioned the tribunal for issuing arrest warrant against Ghulam Azam.
On December 13, the ICT fixed December 26 to give order on taking into cognizance the formal charges of ‘crime against humanity’ against Ghulam Azam in response to an appeal by Jamaat lawyer Barrister Abdur Razzak.
On November 1, the probe report against the Jamaat-e-Islami supremo was submitted to the prosecution panel of the tribunal in connection with their alleged wartime crimes against humanity.
“We have prepared a 360-page report of findings in support of the charges of wartime crimes against former Jamaat Ameer Golam Azam. A total of 40 people gave dispositions against him,” Arif said.
