Reducing Mêlée by Reinstating CTG?

After the prime minister’s comment on the interim government, a positive gesture has been marked in the political firmament of the country. Like the prime minister, all her party-men and the political allies have begun to chorus with her on the interim government.

 

However, finally BNP has planned to make a formal proposal to the government to restore the caretaker government to ensure the upcoming poll free and fair and in a peaceful manner.

 

Meanwhile, the government already has amended the constitution by repealing the caretaker government as per the direction of the High Court. Though, the government’s claim of repealing the caretaker government as per direction of the court is not fully acceptable so the fact is concerned. The government has repealed the constitution much before the judgment is appeared to the nation. However, the short delivery of the verdict has proposed to maintain the status quo of the caretaker government for next two polls. This part of the judgment has been ignored by the government. In other words, this part has been violated by the government as the main opposition has strongly opposed to repeal it. They rather carried out movement for the caretaker government.

 

To restore the caretaker government or to any other forms of the government, the incumbent provision of the caretaker government as laid down in the constitution need to be amended further. However, going back to earlier provision might not be possible, or is not pragmatic at all.

 

We have a mixed reaction on the caretaker government at least after the last caretaker regime. But, let alone this, the milestone achievement of the caretaker government is that it has and could establish the people’s right to vote; the only practices political right of the country.

 

Though with this achievement, the caretaker government has ruined the image of some of our major state organs. Tussle between the political parties on the judiciary has blurred the image of the highest court of the country. The judiciary has been tried to be politicized on the issue of the caretaker government. The government used to chalk out their schedule as to the formation of the caretaker government as per their plan and people.

 

The party in power has violated the long practicing custom to promote the senior most judges to their due position. The party in power has either promoted the judges breaking the seniority or abstained from doing it to ease the path of being the chief of the caretaker government of their favorite judges. By doing so, the judiciary has been disparaged by the government and the political parties.

 

Considering all those experiences, the proposed amendment of the constitution should be made to avoid any further political errors in future.
