DHAKA: The Supreme Court Tuesday upheld the High Court ruling that declared illegal the Modhumoti Model Town project at Aminbazar in Savar.
A six-member Appellate Division bench headed-by Chief Justice Md Muzammel Hossain delivered the verdict in response to an appeal filed by Bangladesh Environmentalist Lawyers` Association (Bela).
Bela lawyer Advocate Iqbal Karim Liton confirmed the matter to banglanews.
He said, “Modhumoti Model Town authorities and the people who purchased plots at its Aminbazar project cannot construct any structure on the project area following the verdict.”
Earlier in 2004, Bela challenged the project in the High Court.
In 2005, the HC declared the project at Aminbazar unauthorised, illegal and against public interest.
But, Builders Metro Makers and the plot buyers had separately moved the Appellate Division against the High Court order.
The apex court on Tuesday cancelled Metro Makers` plea to continue with their project, ruling in favour of BELA.
In the petition, Bela said if the project will be destroy the area and its environment will be polluted.
Bela also appealed to the apex court to take initiative so that the capital city remains free from water logging.
