DHAKA: The High Court (HC) Tuesday issued a rule upon the government to explain within four weeks why the section-6 of Representation of the People Order (Amendment) Act-2009 “should not be declared contradictory to constitution”.
An HC bench comprising Justice Mirza Hossain Haider and Justice Kazi Md Izarul Haque Akanda issued the rule after the hearing of a writ.
Former additional secretary and columnist Abdul Hye filed the writ with the High Court mentioning that the section is contrary to the article no 66(1), 66(2) and 142 of the constitution of Bangladesh.
During the hearing, Advocate Imtiaz Faruk moved for the writ while deputy attorney general Al Amin Sarker stood for the state.
According to the rule, law secretary, home secretary and election commission were asked to submit the application within four weeks to the HC.
