DHAKA: Independent candidate Bazlul Haque cannot contest the upcoming Gazipur-4 by-poll as chamber judge stayed for eight weeks a High Court order that asked EC to allow him to contest the poll.
Earlier, the Election Commission (EC) cancelled the candidacy of Bazlul Haque.
Later, the candidate appealed before the EC against cancelation of his candidacy. After hearing, the EC upheld the decision of returning officer.
Then, Bazlul filed a writ petition with the High Court to include him as independent candidate and the court directed the EC to accept the nomination paper of him.
On Wednesday, the commission filed a petition to the Supreme Court seeking stay on the HC order.
After hearing, Chamber Judge Wahab Miah passed the stay order and directed to hold election on time.
On behalf of the EC, Additional Attorney General MK Rahman filed the petition with the Chamber Judge Court.
After passing the order, he said, “Bazlul cannot contest in the Gazipur-4 by polls as HC order was stayed.”
On the other hand, Election Commissioner M Shahnewaz told reporters that, as per section C of article 125 of the constitution, any order has to be passed giving more time to EC after poll scheduled declared.
He added: “As per the constitution, court cannot pass any order without consultation with EC. We did not received any notice from court and not to get chance to take part in the hearing. So, we informed the court over the matter.”
