Dirty Picture!

Who is above law? The answer is a straightforward no. But this may be a hypothetical one when go for the veracity of its application in our perspective.

Bringing to book of some celebrated and notorious criminals does not necessarily indicate the rule of law is already established at its own course rather it may stand as a omen to the citizenry that rule of law will prevail with its due course. It is the general expectation of the people to be ruled by law at least in a democratic society. The key distinction drawn between monocracy and democracy is that the lather is based on rule of law, justice and equity and the former is on caprice of the ruler. And democracy is chosen as the best option for modern state polity.

While we are on the subject of ours, we witness a somehow different perception of democratic behavior by some segments of the state and the society at large.

This practice of disregarding law is prevalent in our society though we have achieved democratic form of government for more than two decades.

But entering into a system of forming government by mass franchise is not enough and not the only prerequisite for democratic government. To transform from autocracy to democracy, a massive change in the state machinery and above all in the mindset of the authority is the ultimate order in fact. If those ceremonial bureaucratic methodology is not done away with from our mindset, true democratic grow up will not happen. For this many of our state authorities are yet in their haughty thoughts and attitude.

Only the simple citizens feel that they are not above law. They have a feeling in the minds that if any offence is committed by them the law enforcing agency will arrest him and he will have to undergo punishment for the offence. But it does not mean that they have a great loving for law, rather they have the real idea that they have no refuge and broad-shouldered boss to save them.

Those who have those bosses and those who are those bosses themselves have no admiration for law. Even they do not need to have that.

The concept of ethics, discipline and submission to the law is almost obsolete to the people; especially if shored up by power mongers. Or if you have some sort of administrative power, you are above law for always.

Some very recent events have demonstrated that we are yet to get rid of this elongated colonial way of thinking and external conducts. By this an absolute disregard to law and extreme superciliousness has been reflected.

Any member cannot but be worried and aggrieved at the scene depicted by some of our police members. Definitely, it does not give the whole picture of our police and law enforcing agencies. But it has definitely tarnished the image of the police.

The justice seeker cannot be devoured by the justice providers. And if those incidents are protested by some journalist and lawyers without further ado, they must not be debased further. But very deplorably, both of those incidents have happened while a girl and her mother has sought justice; they have been abused and the journalist and lawyers were beaten up as well by some police members.

Such instance of violation of human rights and breach of disciplinary rules by police will not be put up with by the police department; rather it will be probed and brought to book.

In addition to this, the government cannot shoulder away its responsibility so far the incident has been conducted by the government agency. However, it is ultimately upon this democratic government to decide whether such incidents will be taken into account or ignored. The government will have to decide whether it will let such picture to release or censor such type of dirty picture forever for future reference.
